By continuing to browse and use this website you are agreeing to comply with and be bound by the following terms and conditions of use, which together with our privacy policy govern Mind Retreat’s relationship with you in relation to this website.

The terms ‘Mind Retreat’ or ‘us’ or ‘we’ or ‘our’ refer to the owner of the website incorporated in the UK as Mind Retreat Candles whose registered office is 26 Rochester Drive, Burnley, BB102BH. The term ‘you’ refers to the user or viewer of our website.

These terms and conditions apply to the use of the Mind Retreat website. By placing an order with us, you are agreeing to accept these terms and conditions. Please note, these terms and conditions are subject to change at any time without notice. It is the customer’s responsibility to review and agree to our terms and conditions prior to the purchase of any item.

1.1 It is not necessary to register with us in order to use most parts of this website. However, particular areas of this website will only be accessible only if you have registered.

Use of website

1.2 This website may be used for your own private purposes and in accordance with these terms and conditions.

1.3 You may print and download material from this website provided that you do not modify or reproduce any content without our prior written consent.

Website uptime

1.4 All reasonable measures are taken by us to ensure that this website is operational all day, every day. However, occasionally technical issues may result in some downtime and accordingly we will not be liable if this website is unavailable at any time.

1.5 Where possible we always try to give advance warning of maintenance issues that may result in website down time but we shall not be obliged to provide such notice.

If an error is discovered in the price of the goods that you have ordered, we will inform you as soon as possible.

We shall be under no obligation to fulfill an order for a product that was advertised at an incorrect price.

In the unlikely event that you receive goods which are not what you ordered or which are damaged or defective, or are of a different quantity to that stated on your order form, we shall make good any shortage or non-delivery, replace or repair any damaged or defective goods, or refund to you the amount you paid for the goods, provided that you notify us of the problem 7 days of delivery of the goods, and return the goods to us, unless we inform you that return is not necessary.

We have taken every measure to provide accurate product images for each product for sale on the site. However, due to a number of different factors such as variations in internet browsers, monitor colour settings, etc, we cannot be held responsible or liable for any differences in colour between the image and the actual product.

Our products are handcrafted; therefore it is natural that some variation in colours and hues exists. We use a premium, natural soy wax which often takes on a ‘frosted’ or dappled appearance. This is quite normal and adds to the character of our products.

The products sold on Mind Retreat are provided for private domestic and consumer use only. Accordingly, we do not accept liability for any indirect loss, consequential loss, loss of data, loss of income or profit, loss of damage to property and/or loss from claims of third parties arising out of the use of our website or from any products or services purchased from Mind Retreat.

Good candle care and maintenance is the responsibility of the user; please follow safe practice at all times and read the candle safety information, provided by the fire service, prior to using any candles or wax melts purchased from Mind Retreat. Mind Retreat is not responsible or liable for any damage or injury which occurs due to lack of care or attention when burning our candles. In any case, our maximum liability to you is the amount you originally paid for the product.

We shall have no liability to you for any delay in the delivery of products ordered or any other matters to the extent that the delay is due to any event outside our reasonable control, including but not limited to acts of God, war, flood, fire, labour disputes, strikes, lock-outs, riots, civil commotion, malicious damage, explosion, governmental actions and any other similar events.

We make no warranty that our website will meet your requirements or will be uninterrupted, timely or error free, that defects will be corrected, or that the site or the server that makes it available are free of viruses or bugs or represents the full functionality, accuracy, reliability of our website.

We will not be responsible or liable to you for any loss of content or material uploaded or transmitted through our website. To the fullest extent permissible under UK law, we disclaim any and all warranties of any kind, whether express or implied, in relation to all the goods we sell. This does not affect your Statutory Rights as a consumer, nor does it affect your Contract Cancellation Rights.

We will not be liable, in contract, tort (including, without limitation, negligence), pre-contract or other representations (other than fraudulent or negligent misrepresentations) or otherwise out of, or in connection with, the conditions for; any economic losses (including without limitation loss of revenues, profits, contracts, business or anticipated savings), or any loss of goodwill or reputation, or any special or indirect losses suffered or incurred by that party arising out of or in connection with the provisions of any matter under the conditions.

Exclusion of liability

1.14 We do not accept liability for any loss or damage that you suffer as a result of using this website.

1.15 Nothing in these terms and conditions shall exclude or limit liability for death or personal injury caused by negligence which cannot be excluded or under the law of the United Kingdom.

Shipping

1.16 Your order will be processed and delivered without undue delay, no later than 30 days after your order has been placed.

1.17 Please allow for up to 7 working days for delivery following the dispatch of your order.

Cancellations, returns and refunds

1.18 All customers have the right to cancel their order under the Consumer Contracts (Information, Cancellation & Additional Charges) Regulations.

1.19 Your right to cancel an order for goods starts the moment you place your order and ends 14 days from the day you receive your goods.

1.20 To meet the cancellation deadline, please notify us via email or phone about cancelling the order before the cancellation period has expired.

1.21 If you are in possession of the goods you are under the duty to retain them and take reasonable care of them. You must send the goods back to us to our contact address at your own cost (unless we delivered the item to you in error or the item is damaged or defective) as soon as possible once you have cancelled the order.

1.22 We reserve the right to make a charge not exceeding our direct costs of recovering the goods if you do not return the goods or return them at our expense.

1.23 Once you have notified us that you wish to cancel the order, any sum debited to us will be refunded to you as soon as possible and in any event within 14 days of your cancellation.

1.24 You will not have any right to cancel an order for the supply of any of the following goods:

(a) medicinal products or services that are either dispensed on prescription or are available free under an NHS arrangement.

(b) a contract for passenger transport services - such as bus, rail or flight tickets.

(c) the supply of goods or services where prices are dependent upon fluctuations in the financial markets, which are beyond the control of the retailer.

(d) the supply of goods that are made to the customer's specification or are clearly personalised.

(e) the supply of goods that are liable to deteriorate or expire rapidly - such as a delivery of fresh flowers or meat.

(f) the supply of newspapers, periodicals or magazines.

(g) the supply of accommodation, transport of goods, vehicle rental services, catering or services related to leisure activities if the contract provides for a specific date or period of performance - for example, hotel bookings, courier services, car hire, restaurant bookings and theatre tickets for specific dates.

1.25 In addition you will lose your right to cancel if you:

(a) unseal goods that are not suitable for return if they are unsealed, due to health protection or hygiene reasons.

(b) unseal audio, video recordings or computer software that were sealed at the time of delivery.

(c) combine goods with other goods after delivery so that they become inseparable.

Law and jurisdiction

These terms and conditions are governed by English law. Any dispute arising in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the Courts of England and Wales.

Data Protection / Privacy

Mind Retreat do not hold your credit/debit card details and will not pass your name or address to any third parties. All payments are processed through Paypal Checkout. This service reduces the risk of fraud and makes internet transactions more secure by utilising state of the art encryption to protect your personal details. We will never ask for personal details via email. If you receive an unsolicited email asking you for your Mind Retreat log in details, please inform us immediately.

This privacy policy sets out how Mind Retreat uses and protects any information that you provide when you use this website. We are committed to ensuring that your privacy is protected and we are fully compliant with all General Data Protection Regulations. Should we ask you to provide certain information by which you can be identified when using this website, you can be assured that it will only be used in accordance with this privacy statement. Mind Retreat may change this policy from time to time by updating this page. You should check this page from time to time to ensure that you are happy with any changes. This policy is effective from 01/03/2019.

We use this information to better understand your needs and provide you with a better service, and in particular; for internal record keeping, to help improve our products and services, and to stay in contact with you.
